  2.               The RIACS Software Policy.

  8.                   1. INTENT
  9.                   ---------

  11. This section is only a summary of the intent of this document, and
  12. does not represent the actual software distribution policy of the
  13. Research Institute for Advanced Computer Science (RIACS).
  14.  
  15. + The software written at RIACS comes with absolutely no warranty.
  16.   RIACS distributes research and prototype, but no production,
  17.   software. 
  18.  
  19. + The software written at RIACS will contain one of two copyright
  20.   notices, indicating whether or not it may be redistributed.
  21.   Prototype software will contain the "restricted distribution"
  22.   copyright, and is for testing and comments only.  Research software
  23.   will contain the "reserved distribution" copyright, and may be
  24.   given to other parties.

  26. + Any software written at RIACS may be modified and duplicated,
  27.   however if you modify any file you must clearly state in the file
  28.   when it was altered, and who altered it.

  32.   than a nominal fee for making the redistribution.

  40. RIACS software containing the following RIACS copyright notice,
  41. hereinafter referred to as the Reserved RIACS Copyright, but only under
  42. the RESERVED conditions stated in sections 2.1, 2.2, and 2.3.

  45.     All rights reserved.  The RIACS Software Policy contains specific
  46.     terms and conditions on the use of this software, and must be

  82. such software, and you may at your option offer warranty protection,
  83. which is not mandatory, in exchange for a fee.  You may not charge a

  159. Aeronautics and Space Administration (NASA), the University Space
  160. Research Association (USRA), RIACS, or any person associated with
  161. these organizations.  These parties DO NOT accept responsibility for
  162. the consequences of anyone using any of this software, for whether it
  163. serves any purpose, or for its working order.

  165. Because all software distributed by RIACS is either research or
  166. prototype software, and is free of charge, NASA, USRA, RIACS, AND ANY
  167. PERSON ASSOCIATED WITH THESE ORGANIZATIONS PROVIDE ABSOLUTELY NO
  168. WARRANTY TO THE EXTENT PERMITTED BY APPLICABLE STATE LAW.  EXCEPT
  169. WHEN OTHERWISE STATED IN WRITING, ALL SUCH SOFTWARE IS PROVIDED "AS
  170. IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED,

  179. liable for any claims or demands by you or any other party, or any
  180. other claim or demand against NASA, USRA, RIACS, or other party due
  181. to or arising out of your use or inability to use any such software,
  182. and you agree to indemnify and hold NASA, USRA, RIACS, and any other
  183. party who may modify or redistribute software received from RIACS as
  184. permitted above harmless against all such claims.

  191. By accepting software and this Software Policy document from RIACS, in
  192. any form or medium, you are accepting the terms and conditions set
  193. forth in this document.

  195. You may not duplicate, license, distribute, or transfer any software
  196. containing a RIACS copyright except as expressly provided under this
  197. Software Policy.  Any attempt to otherwise duplicate, license,
  198. distribute, or transfer this software will terminate your rights under
  199. this agreement.  However, parties who have received software from you
  200. with this Software Policy document will not have their rights
  201. terminated so long as such parties remain in full compliance with the
  202. terms and conditions herein.
